Samantha Halem practices law exclusively in the areas of employment law and employment litigation. After receiving her A.B. from Stanford University, Ms. Halem earned her Juris Doctorate, cum laude, from Harvard Law School. While at Harvard, Ms. Halem served on the Executive Board of the Harvard Civil Rights and Civil Liberties Law Review.

After graduation, Ms. Halem served as a law clerk for the Honorable Richard A. Paez at both the Ninth Circuit Court of Appeals and the Federal District Court for the Central District of California. Ms. Halem subsequently worked as an associate in the labor and employment departments of both the California law firm of O’Melveny & Myers, LLP and the Boston law firm of Goodwin Procter, LLP. She is a member of the Massachusetts, New Hampshire, and California bars.

Ms. Halem regularly counsels clients in all aspects of employment law. She advises clients on a day to day basis on issues such as discipline, investigations, leaves of absence, and accommodations. She drafts handbooks, policies, employment contracts, and separation agreements, among other employment documents.

Ms. Halem is also a successful litigator, representing clients before state and federal courts in multiple jurisdictions, including Massachusetts, New Hampshire, California, Connecticut, Florida, New York, New Jersey, and Michigan.

Ms. Halem has also appeared before several different state human rights agencies, the National Labor Relations Board, and the Equal Employment Opportunity Commission in multiple jurisdictions. She has also successfully represented clients before arbitrators and in mediations.

  • Defend employers against wage and hour, discrimination, harassment and other complaints filed with administrative agencies.

  • Direct and/or conduct investigations into alleged illegal or improper behavior.
  • Help employers respond to specific employment issues.
  • Represent employers at the arbitration or mediation of employment disputes.
  • Review and/or draft offer letters, warnings and other communications with employees.
  • Draft and negotiate separation agreements.
  • Counsel clients facing difficult or sensitive employment issues.

We also offer a Human Resources Audit designed to evaluate and recommend improvements in our clientʼs employment policies, practices and communications. The Audit covers all significant Human Resource issues and provides us with a fundamental understanding of each client’s policies, practices and culture.

Therefore, we have developed practice-tested forms, policies and model documents that can be tailored to meet any employer’s needs. Over the years, we have evaluated and advised employers about virtually every employment issue or claim.

Although we are located in Massachusetts, attorneys at Marshall Halem represent clients throughout the United States. For example, attorneys at Marshall Halem have recently and successfully litigated cases in Florida, New Jersey, Illinois, Pennsylvania, California, North Carolina, Minnesota, New Hampshire, Texas, New York and Vermont in addition to Massachusetts. We have also defended charges filed with the National Labor Relations Board, the Massachusetts Commission Against Discrimination (“MCAD”), the Pennsylvania Human Relations Commission, the New York Commission on Human Rights, the New Hampshire Department of Labor, agencies in other states, the Equal Employment Opportunity Commission (“EEOC”), and United States Department of Labor.
